Wat happen if u involed in an accident? how to settle claims

hi i’m a newbbie in this forum… and a new driver too.. passed my tp in march this yr.. just had an accident last wk not quite sure wat to do.. it’s he hit me frm the back. at CTE exit filter lane.. wat are the neccessary procedures and particulars of parties involed in accident?? i took down everythign in his I/C but he just dun wan to give me his hp no. how to claim?

well, u claim against his insulern, he claim from ur insulern, if u got his name, NRIC, liecern plate then ok liao…HP even if u got also not much use cos if he wanna siam u by not responding to ur calls u also bo bian…if got injury go make a police report at ur nearest NPP/NPC ASAP.

For accidents with injuries:

Call police, remain at the scene.

For non-injury:

i think the most important detail to take down is the other party's license plate, because everything else can retrieved from it. If possible, take the driver's IC details too.

Then visit the nearest IDAC for them to record down the damages to your vehicle. I believe they will ask for your vehicle insurance details which you should have in your vehicle and should help you with your claim form.

Finally, confirm with your insurer where the vehicle should go for repair, give them a call.

Things not to do:
1. Do not bother arguing with the other driver, absolutely nothing is accomplished

2. Do not attack the other driver

If you want to settle the matter privately, remember to get it written down and both signed on it. Juz a short and sweet note will do. Main thing to state is that both agreed to settle and not report to insurance or police.

Don't be play out as I have a friend who went through hell for it. 2 weeks after the accident was supposed to be settle privately, he received a summon from the police and a claim from the insurance, despite paying the other party $300 to settle. He has no prove to show he pay, so in the end, he got 9 points, $150/- fine and almost $5000/- claim from insurance( he pays excess $1000/-). Cursing all over as he kiss the other guys's ass.

So better be careful.

thanx for the info.. but wat if the other party saes it’s my fault when reporting? and will it affect my father’s insurance preium? coz when i go report the case to my insurance.. the fellow sae 90% can claim.. but if the other party sae another stroy which pushes the liabilty away then i will have to pay 50%... and it will afftect my dad’s insurance preium…

The investigators will not really seriously consider both sides' stories because either one could be making false accusations, just as you said. Instead they will look for 2 things, the areas where the cars were damaged and the statement of any independent eye witnesses (meaning people who were not in your vehicle but saw the accident).

Generally, the vehicle whose rear got damaged has a pretty strong case.....abt 80-90%. Damage to the side gives you about 50-50 chances of winning. These were the usual rates according to IDAC.

As for eyewitnesses, if they are not related to you...probably stronger case.

For your case since the other person hit you from behind, you should probably make a claim to his/her insurance.

One other thing... as far as possible, take pictures of the damage at the accident site immediately - both vehicles.

I heard of instances where the other party got into a second accident after the first one and pinned all damages on the first incident.

Hmmm.... Anyone else sees a problem with the whole system here? The people who decides who is in the right and wrong weren't even present when the accident happened.

Your insurance company can easily accept 30 to 40% liability, and then remove your NCB the following year. Beneficial to them if the amount claimed is small no? Rolling Eyes

I was involved in a little accident more than a year ago on the highway. Traffic stopped, so did I and another car hit me from behind and my car moved forward a little and bumped the car infront of me. The guy infront had a brand new car so understandably he wasn't too happy with the little scratch on his rear bumper.

We all made our individual claims (and luckily the guy behind me admitted full responsibility). I thought everything was settled. When I tried to renew my insurance 2 months ago, I found out that my insurance company stripped away my NCB because of that accident. Seems that the insurance company of the guy infront of me, and my insurance company has still not decided if my insurance should pay, or the guy behind me should pay for the front guy's bumper. Evil or Very Mad

Just a tiny scratch, if my company wants to pay the full $100 or so to touch up the little paint work... my premiums rise by 50% !!!!

There has to be a better way than this. The party who has the most to gain (i.e. insurance companies) can not be the ones who decides on who pays what!

Mine was..

Cabstar driver not happy I cut into his lane earlier on.
Cabstar driver overtakes me from the left at CTE sliproad.
In the process, cabstar's right back clips front left side of my car as he accelerates past me.
IDAC says 50-50 chance of claiming against cabstar driver's insurance since side damage.
TP says no evidence, and asks me for independent eyewitnesses (on an expressway)....ya right Rolling Eyes

Gone are all the good old days, whereby you settle privately and it is honoured.

So what to do, since the police no longer takes up non accident cases, there will always be dispute and the only one to gain is the insurance company.

So be careful on the road and pray no one bumps into you or fly across from opposite direction. As I have always told my wife when she tells me to be careful on the road..I told her" you should tell the rest of the drivers to be careful...

be very careful during accidents, my ah lao saw in vios club that one vios slightly kiss the back of another car... lightly scratching the bumper... both agreed to settle privately but when the bill came, $1800!!!

Now the young Vios driver in a fix!!

So now I put a instant camera in the car coz my phone has no camera. So that In event of accident (choy choy choy!!!) should take as least 5 picture of both cars.
Draw on a piece of paper if no camera and make the fellow sign next to his I/C number and name. Oso remember to go to IDAC to get the assessment.
