Defamation Suit Monitoring: July 31st to August 4th 2006

Richard Gibbs Q.C. went to Singapore to observe and report on defamation proceedings against Dr. Chee Soon Juan and Chee Siok Chin set for hearing on August 3rd, 2006 in the High Court of the Republic of Singapore in two actions brought by the former and present Prime Ministers:

o Lee Kuan Yew v. Singapore Democratic Party et al - case No. S262/2006Q
o Lee Hsein Loong v. Singapore Democratic Party et al case No. S261/2006Q

Dr. Chee Soon Juan has long been the target of persecution for speaking publicly on human rights and governance issues. Dr. Chee is the Secretary-General of the Singapore Democratic Party (SDP), the small opposition to the Peoples Action Party (PAP) that has been in power for almost five decades. Chee Siok Chin was a candidate for SDP in the last election. Earlier this year, Dr. Chee was declared a bankrupt for failure to pay S$500,000 damages awarded in a civil defamation suit brought by two PAP former Prime Ministers, Lee Kuan Yew and Goh Chok Tong.

Gibbs was denied access to the August 3rd 2006 proceedings when the proceedings were moved from the courtroom to the judges office and Justice Woo Bih Li refused Dr. Chees request to have Mr. Gibbs present. Also present in the courtroom and denied access were many members of the press and a representative of Amnesty International. In September at a summary hearing, the court gave judgment for the plaintiffs (Lee and Lee) and damages have yet to be assessed.

The use of civil defamation suits in Singapore by high level PAP members against critics has proven an effective tool to prevent opposition at the parliamentary level and to punish human rights defenders. Excessive damage awards and unfair bankruptcy proceedings have severely restricted the ability of PAP critics J.B. Jeyaretnam, Dr. Chee and Ms Chee to participate in public affairs by barring them from public office. In Singapore judgment debtors, where the judgment debt exceeds S$2,000, are barred from public office for a period of 5 years from the date of judgment. Undischarged bankrupts are also barred from public office. This use of defamation and bankruptcy laws has also had a chilling effect on the willingness of lawyers in Singapore to represent defendants in politically sensitive cases brought by PAP members.

On November 23rd 2006, Dr. Chee was sentenced to five weeks imprisonment for refusing to pay a fine for speaking in public without a permit. Organizations publishing statements critical of the conviction and imprisonment included: LRWC, Amnesty International and Human Rights Watch.

OVERVIEW
[1] This is an appeal by Enernorth Industries Inc. (Enernorth) from a judgment granting an application brought by Oakwell Engineering Limited (Oakwell) for an order recognizing and enforcing in Ontario a judgment granted against Enernorth by the High Court of the Republic of Singapore on October 16, 2003 and affirmed by the Court of Appeal of the Republic of Singapore on April 27, 2004. The judgment under appeal also dismissed an application brought by Enernorth for a declaration that the Singapore judgment cannot be recognized or enforced in Ontario.

[2] The appellants position is that the Singapore judgment was granted by a corrupt legal system, with biased judges, in a jurisdiction that operates outside the rule of law and, as such, ought not be enforced in Ontario.

[3] The respondents position was accurately summarized in the application judges reasons as follows:

While Oakwell acknowledges that Enernorth has tendered some evidence relating to possible government interference in trials, all of that evidence applies only to political cases. The case at bar is a commercial case. There is no evidence that Singapore courts are biased when deciding a commercial case between private parties.

With the passing of the bill to allow the Prime Minister to nominate up to two members of the Legal Service Commission, this would mean that more powers would reside in one person, instead of popular concensus that power should be distributed, so that abuse by one person is not possible.

Chief Justice Yong held that any Law which deprived a person of his life or personal liberty was valid and binding as long as it was validly passed by parliament. The courts, he said, 'is not concerned with whether it is also fair, just and reasonable as well.**

This is the Chief Justice that was appointed by the Executive who was a classmate if Lee Kuan Yew.

Chief Justice Yong "(The court) is not concerned with whether it is also fair, just and reasonable as well."

We have a Chief Justice that is not concerned whether the a law or Judgement is just?

The Definition of justice

4. The upholding of what is just, especially fair treatment and due reward.

If you agree that with the above definitions of justice, do our courts then deliver justice when our judges words contradict most of the above definition of justice?

In a large company, it's always wise to distribute the powers evenly amongst the top executives. e.g. Chief Executive Officer, Chief Financial Officer, Chief Operating Officer, Chief Information Officer, etc.

This is to prevent a single dominant power figure at the top, if too much power is left with one person, it is possible for this person to commit fraud and conceal it from the knowledge of auditors.

Although the powers are distributed amongst the top executives, fraud is still possible with the collusion of top executives. But a fraud with many participants is easier to discover than a fraud committed by only one participant.

In April 2006, LRWC applied unsuccessfully to intervene in Enernorth Industries Inc.v. Oakwell Engineering Limited before the Ontario Court of Appeal; Richard Gibbs Q.C. and Kelley Bryan were counsel for LRWC.

The Enernorth appeal involved the issue of whether a judgment of the High Court of Singapore, affirmed by the Singapore Court of Appeal, should be enforced in Canada when the record demonstrated a lack of judicial independence by Singapore judges in some cases. Expert evidence presented by Enernorth indicated that Singapore judges used their judicial powers in some cases, to support the interests of members of the Peoples Action Party (PAP). The Ontario Superior Court of Justice had held that actual bias must be proven and that the Canadian court would not consider the general failings of the foreign legal system. Oakwell maintained that the evidence presented by Enernorth indicated only that Singapore judges lacked independence in political cases and did not establish bias in commercial cases. Counsel for Enernorth argued that a systemic lack of judicial independence in any class of cases destroys the right to, and presumption of judicial independence.

M13, instead of wasting your time talking about nonsense why dont you just stick to your ejeculating sperms and panties sniffing stories?

There was once I went to a friend's place to check out his new audio system....my friend was staying in the nice apartment together with his sister (who is Singapore supermodel ) and parents, who were away on that day.....when I first arrive, nobody was there accept for my friend.....then at about 10.30 in the evening......this tall, gorgeous looking girl walks inthat was the first time that I see his sister in person....she was stunning, wearing this worn out jeans and white T-shirt......she was very friendly and sat down with us for about 15 mins before going to her room to take her shower.(her sister room is actually linked to the common toilet that I have been using before she came back)..and after about 20mins...her sister open the toilet door..and I quickly make my way to the toilet cause I need to pee badly.

When I was enjoying my pee.I was shock to see sometime lying on the laundry basket cover ..it was my friend sister's used panties and bra...she just remove a few minutes agoand you can see that the stain on it is still wet....(must have forgotten that I am in the house)..when I see that....my heart start to pump in double quick timeand without much thinking........my hands went straight down to reach for it..the panties that I was holding is white in color......and it comes with some yellowish stain ...while I am holding it.....my mind was trying to picture her supermodel face together with the panties.man it was really mind blow...then I start to smell it..

I know it might sound sick and crazybut the curiosity of knowing how a supermodel pu$$y smells like is just irresistible.
