A 39-year-old Lebanon woman was sentenced to 30 days in jail
Wednesday after pleading guilty to allowing an older man to have
sex with her underage daughter.
Donna Rose, who lives on Hunters Run, not only gave Curtis Lee
Barnes oral permission to have sex with her then-15-year-old
daughter, she signed a permission slip, Warren County prosecutors
said Wednesday.
"... he always had and will (have permission to have sex) until she
is 18 or until they break up," states the permission slip that
Barnes gave to investigators after the young teen got
pregnant.
The slip is signed by the mother and there is a signature of a
witness, court officials said.
Having sex with someone who is between the ages of 13 and 16 is a
felony.
"He offered the permission slip as a way out of the trouble," said
Warren County Prosecutor Rachel Hutzel.
"And he said it is not a crime because he had permission. Our
response is, it is absolutely a crime."
Barnes, now 20, was convicted earlier this year of unlawful sex
with a minor.
On June 2, he was placed on three years' probation, and ordered to
undergo drug and alcohol treatment at a locked facility. He also
was designated a sexually oriented offender and is required to
register with local authorities as an offender for the next 10
years.
"Rose violated a position of trust. She had a responsibility to
protect her daughter from sex offenders, not give them written
permission," said Hutzel in a prepared statement.
Barnes had been living with the family and sharing the bedroom with
the girl for about a year. Barnes was paying $20 in rent every two
weeks.
Rose also was designated as a sexually oriented offender and must
register with local authorities for 10 years.
