Illegal downloads only consists of files which breach copyright laws.
Videos and music that have not been licsenced is not considered illegal.

Any program that is freeware and/or opensource is also not illegal.

Technically,

example:
You download a game that is a "full" retail version. -> illegal

You download a game that is a trial version. -> legal

You download a "crack" -> legal

You download a game that is a trial version. and it's crack -> legal

You download a game that is a trial version. and it's crack and you use the crack -> illegal
