I have a guy friend who always use his hp to sms girls(most of them he don't know them) and ask them for sex.

He will say something like "Hi. Want to have sex. I am willing to pay"

If these girls reports to the police and the number is registered under his name, is this considered as sexual harrassement and can he go to jail?

From what u say, the case seems mild so I dun think there will be any trouble. Unless he send threatening SMS then it will be different.

But I am not from SPF nor legal, anyone can confirm?

This is considered sexual harassment. As long as the other party feels insulted by the comments, he/she has a case to report.

cos now the police have asked him to go for questioning and claims that he will send a report to AGC after that and says that this is a chargable offence. Say what this is outrage of molesty.

Don't know whether is he just trying to scare my friend anot.

My friend never even touch the girls before so what outrage of molesty is there..

i am not sure if the case will go court or not. but this is a case of outrage of modesty.

just like u walk up to a random lady, and say u wanna have sex with her. she can call the police right away.

u dont have to physically touch someone to be considered abusing. there is another thing called spiritual/mental abuse.

I believe U dun give the whole picture here. There should be something else that your friend has said to the police.

U can advise your friend to apologies to the girl in front of the police if she really feel offended. SMS only mah....just say yr friend mistook her for someone else loh!!!

Anyway I believed it is the girl who go to the police. Let it be a civil rather than criminal litigation case lah.

Than the police say that it is AGC who will decide whether to prosecute him anot not the girl. The police only do the investigation.

Its up to him to argue that his intention is not true to his actions. ie the sending of sms.

Otherwise, its obvious your friends actions is directly linked to his intentions.

And his intentions was to ask for sex from random girls which in turns in outraging their modesty.

And in this event, he insuniated that the females are functioning as prostitutes, by telling the girls he can pay.

So you say leh. If this blow big, you want to help him pay his fines and sit in jail for him?

Even one girl is not a girl?

Yes, AGC can decide to persue or not.

But ultimately, if the girl wants to plays this big, AGC will have to comply to her intentions and charge your friend to court and penalise him anyway.

Aiyah....you didnt read meh.

This TS is very zai....he always help out stupid policemen in their investigations.

So of course his friends might have think he really know a lot of things mah.

FYI, AGC represents the public interest. If one more female were to show up and lodge a police statement regards to that friend's sms.

Then AGC can take up to persue actively.

But if they decide that one girl report only, small matter, just fine the friend can liao.

And if the girl is still not satisfied that this is enough punishment. Can go ahead and blow it bigger and the AGC will have to go thru this again and fine/jail the friend lor.

Do not assume that just because you think AGC says not the girl make decision, you think its safe.

Frankly, the decision maker is the complainant and the judge.
