In essence, TS, I summarize for you:
who has the final say on the proceedings will depend on two
things:
1) nature and classification of the offence disclosed, and
2) the type of investigation currently being conducted.
If it is a Magistrate's Complaint that is being lodged, then the
final decision will lie with the complainant .
If it is a formal Police-initiated investigation, then good luck
to your friend. Because in such cases, final decision will lie with
AGC.
But even for Magistrate's Complaints, the Magistrate can use his
/ her discretion to intervene if he / she deems it necessary.
And for what it is worth, have you ever heard of this saying
when it concerns legal matters?
"He who defends himself has a fool for a client."
How to find out if its a Magistrate complaint or
police-initiated investigation?
My friend even call AGC up to check. They checked his name and
they say there are no records on him.
AGC tells him whether its Magistrate complaint or
police-initiated investigation is all depend on how the IO wants to
classify it as..
