Hi guys!
My company has recently informed me through text message that
they are closing down one of their branch without giving me my one
month notice as stated in the contract that was duly signed. When I
bring up the topic on the one month notice, they told me to serve
it at another tuition centre instead, which was not even stated in
the contract. I rejected the idea and told them that they have to
pay me my salary in lieu of notice. From what I know, I've checked
about the transferring with MOM and they said that it must be of
mutual agreement before they can transfer me, if not the company
has to pay me one month of salary in lieu of notice. But they
refused to. So I called up one of the bosses and he shun me off by
saying that the contract is a mistake and it should not be legally
binded. He even dared to tell me that he will go down to MOM to
check.
Although my contract was only a part time contract but it was
still a contract that should be legally binded as it was signed by
the management. MOM even told me that even if its a part time
contract, I will still be covered under the employment act. Now I
am not asking for retrenchment benefits. The thing is they should
be paying me my salary in lieu of notice.
So I'm asking you guys if I've got the rights to bring this up
to MOM so that they can take legal actions against them? Will I win
for this case?
I've just started school and
now they are doing this to me!! What I feel was that it was very
unfair. How can a contract be a mistake? Sigh..
Please advise me. Thank you guys!!
