The German association of defense of the royalties
musical, GEMMATED it, has just obtained a new victory against the
Rapidshare.
The court of Dusseldorf has just decided that the
German host was imperatively to block the access to all the musical
contents corresponding to the repertory of GEMMATED on his platform
of division. A decision which comes here directly to refute the
main argument of defense of Rapidshare, which affirmed that only
its users could be held for persons in charge of violation of
royalties.
The judge considered this defense weak, noting that the
majority of the division lodged by Rapidshare is made on illegal
contents, and that the company draws from the substantial benefit
of these activities. The injunction of the judge is very severe,
because she orders this blocking, whatever are the consequences.
The firm “must take measures which are most probably likely to
decrease the attractivity of the service of RapidShare, or even to
completely make it close” the judgment imposes.
It is the first judgment of a court obtained by
GEMMATED against RapidShare, a decision which makes already
following two legal injunctions against RapidShare, which did not
have, seems it, really not made move the things.
