THIS time, Pacific Internet subscribers who downloaded pirated anime may not be let off so easily, even if Odex loses its case.

The anime distributor was back in the High Court yesterday, in a closed-door hearing during which lawyers for Odex and Pacific Internet concluded their arguments as to whether the anime distributor had the right to apply for access to the names of the 1,000 subscribers.

In August, Odex had a court bid to compel the Internet service provider to reveal these names. The judge then had ruled that the company was only a sub-licensee for anime titles and had no right of civil action.

Under the Singapore Copyright Act, only copyright owners or an exclusive licensee for the anime being downloaded can take legal action.

But this time, the various Japanese copyright owners of the anime titles are ready to get into the fray.

According to Odex's lawyer, they have also made an application to join in as parties in the event the court decides that Odex is not the correct party to make the application for pre-action discovery against Pacific Internet.

Justice Woo Bih Li is reserving judgement, which will be revealed at a later date. Odex director Peter Go said no date has been set for the ruling but his company is willing to wait.

Odex, PacNet summoned to High Court for meeting with judge
Odex and Pacific Internet's (PacNet) lawyers were called back to the High Court on Thursday morning for a brief in-chambers discussion with Justice Woo Bih Li.

The Straits Times understands that Justice Woo raised a number of additional points of law, and asked both parties to give written submissions on their positions on these issues, by the end of next week.

There is no date set for any further hearings, or when a verdict can be expected in the appeal.

Odex, which distributes Japanese animated cartoons or anime here, is appealing a lower court decision denying it access to the names of PacNet subscribers it alleged were downloading pirated anime.

Odex had sent letters demanding thousands of dollars in settlement from SingNet broadband users it alleged were downloading pirated anime.

It sought a court order to get these names, and subsequently managed to obtain a court order to have access to the identities of alleged downloaders from StarHub.

But it failed to obtain a court order to get the names of PacNet downloaders, and it is appealing this now.

The Singapore-based anime distributor had last year carried out a series of suits against local ISPs (Internet service provider) in a bid to extract the identities of illegal downloaders--a move it said was necessary to protect the Japanese animation industry.

Although it won its court cases against StarHub and SingTel, Odex's suit against Pacnet was overturned in a surprise verdict.

However, Justice Woo Bih Li of the Singapore High Court ruled Tuesday in favor of Odex's subsequent contest against the previous verdict, ordering Pacific Internet to disclose its records to the company.

In a statement, Odex noted that the court ruling also prevents Odex from acting on its own against the illegal downloaders. The respective owners of the copyright to the anime titles will instead have to seek direct action against the downloaders.

So far, the Japanese anime distributors that have announced their backing for Odex are Sunrise, Kadokawa Pictures, GDH, TV Tokyo MediaNet, Yomiuri Telecasting and Showgate. Odex said it expects other copyright owners to make "similar applications to the court soon".

Odex had in August last year assembled representatives from the copyright-holding anime firms for a press conference to display the latters' support for Odex's action against piracy.

Said Odex, of the recent court ruling: "This...is a significant boost for us and our principals, as we have always acted for and on behalf of the copyright owners.

"...this decision will now pave the way forward for further enforcement actions by the copyright owners. This decision also shows that those who persist in engaging in illegal downloading of anime programs can no longer use a breach of privacy as a reason to hide behind their ISP."

Pacific Internet recently merged with Asia Netcom to become Pacnet.

This article should be more reliable.

Odex dint win though, the appeal was rejected but names are supposed to be revealed by Pacnet to the 6 Japanese Anime distributors instead.

Court rejects Odex's appeal to reveal downloaders' names

SINGAPORE: Anime distributor Odex Tuesday lost its appeal to the Singapore High Court to force internet service provider Pacific Internet (PacNet) to reveal the names of its subscribers suspected of downloading anime clips illegally.

The appeal was dismissed on the grounds that Odex is just a sub-licensee but not the copyright owner or the exclusive licensee.

Instead, the courts ordered PacNet to hand over the information to the six Japanese companies, Sunrise Inc., Kadokawa Pictures Inc., GDH K.K., TV Tokyo Medianet Inc., Yomiuri Telecasting Corporation and Showgate Inc., which actually own the copyrights.

The ruling has paved way for further enforcement actions by other copyright owners.

Odex said it will work closely with other copyright owners, which are expected to make similar applications to court soon.

The Odex case has seen much interest from the public, especially in online chatrooms and blogs. Many were unhappy last year when Odex forced StarHub and Singtel to reveal the names of those suspected of illegally downloading anime clips. - CNA/ac
