In engaging civil suit, first, you need to consult a lawyer,
even if the lawyer decided that it is not advisable to take up the
case, you still have to foot the bill of basic min $300 for his
service.
My legal advice is, unless you have strong witnesses to stand on
the bar, you stand a good chance of wining this case base on
causing emotional hurt due to other insultation and provacation.
Once the court had awarded the right to the prosecutor, yr lawyer
will then file for compensation of legal fees to be borne by the
defend. For your case, provided you have witnesses, and the award
is against the defender, you will not foot a single cents, what you
lost is only the times in attending court. And in most cases, the
judge will only ask the defender to apologise to your mom.
Dun tell me his own son wish to be witness ya. The other option is
to approach the police and get the report of the stern warning
served to him, in acknowledging the police stern warning,
preferably with signatory of this old man, you also stand a very
good chance of wining him, as in the enforcement laws, he already
admit his wrong doing and heel to the police advices and warning.
But this is not substantial enough and the best is still to have
witnesses.
Nevertheless, such incident are common as a part of our kiasee,
kiasu and kialiao society, without being bodily hurt, it form part
and parcel of our daily life. And in my practice, most of the time,
the court will throw out such cases and order the police to give
warning which the police have already covered themselve.
