Car Rental-Accident...HELP!!

Hi guys....got a scenario here....need advice/views from you guys.

I rented a car and got involve in a minor collision. I immediately reported to rental company. In the agreement that I signed, the access for Collision Damage Waiver is $1000. Damages to rented car is abt $320....already paid.
Suddenly 6 mths later, lawyer letter came to rental company to claim damages to the other party vehicle(its actuallt a company car). Total damage cost ard. $5K (ridiculous!!). Rental company shoot me a letter stating that I should pay since I was the one driving. According to rental company, the insurance only cover for $500 for third party and demanded that I pay the rest.

Is it fair??

i thought the insurance company should settle this..??

How? What is my position now?

I wish you all the luck you need. Because it all depends entirely on what you have signed and the terms that bind the rental agreement between you, the hirer, and them, the rental company.

You either just pay up what's due, or, hire your own lawyer fight your way out but end up paying around the same amount for your lawyer's work.

You can try to seek lawyer’s advise. Some lawyers provide free advise to you.

there should be a excess (max) u need to pay for the car...rest will be covered by insurance.

If not should, there are some volunteer at SAFRA clubs on certain date for free advice...ask with SAFRA on which date have the lawyers

Right. I agree. But it really depends on the term & conditions that you signed with the car company.

When I signed the agreement, the only thing that was mentioned is the Collision Damage Waiver excess of $1K. Nothing else mentioned in the agreement. I got ask around...soem even propose to see lawyer and shoot a letter to the car rental company.

Where got possible Rolling Eyes .... so long liao still claim.... unless the rental company did not buy insurance for the car.... which is impossible.... or else u just need to pay for the exess only wat. If not wat are car insurance for...... Car claims have to be done straight after the accident...... Six months later, who knows how many things can happened liao..... Rolling Eyes

Normally when you sign the agreement, they only mention CDW. But there are still one whole page of terms & condition. So best is that get lawyer to advise first. See if it is worth while to take on the case.
