if we use other people's story for our own animation, issit subjected to any copyright issues? i mean, we search the story online, develope our own character, just like what disney always did, the hercules, the little mermaid, cinderella, etc.
or issit okay if we use a real person's life, like pocahontas?

the Bear SG

copyrighted or not?

if so, you have to negotiate royalties with the people who own the copyright

chenc SG

The court has a set of rules to base on.

Usually if you lift more than 80% of the story, and makes profit from the animation you created, you can be sued.

Its normally ok if its just an internet story you have taken. But if from books or published materials, then the stroy is different.

Using just the gist is fine is most cases, change the names and settings as well.

Correction 90%... you're only allowed access 10% without concent...

Basically, some one is using something to earn money from and they are the creators of it, they have intellectual rights over it.

So lets say Pocahontas is actually a real life person. What disney did was to animate it and create character with likeness to that of pocahontas. The intellectual rights Disney has isn't on Pocahontas but rather on the character they created and related works.

You can draw your own Pocahontas and not infringe on their rights so long you do not ride on what they did.

How you decide whether you ride on what Disney did is very vague, best is you make enough measures to avoid any infringments. The rest is up to the courts to decide.

If someone else's story has been copyrighted, then using that fella's story will cause you to infringe the copyright and render you liable. Bur if there's no copyight to protect the other person's story, you can copy freely all you want.

oh ok thanks.

10%..that means nothing we can copy also...
anyone knows where to get the cool but not very popular story and not copyrighted? Laughing

things like pocahontas etc, the original story isnt copyright cos its a legend... but say someone had written that story 25 years ago.. then it would be copyright and disney would have to pay for the rights to make animation. old old stories, (eg that crazy old monkey tv series which was based on monkey king legend) arent copyright so no one owns the rights so ppl can do what they like with it.

disney is bad with copyright tho... copy right used to expire 25 years after the creator died. mickey mouse copyright was due to expire a few years ago so disney lobbied us government and now copyright is 75 years after creators death and covers even more uses... just so they could protect investment but made life harder for lots of ppl who do works that may come close to crossing the line like pl using parody of things to make political statements etc

what about if we post pics taken from other websites n paste them into forums? Does it offend any copyright law?

But.. we did state where the sources come from..

LazerLordz SG

Citation and usage for commercial gain is different.

A disclaimer with your intent is always expected.

Are you doing a student film/animation project?

scabstermooch SG

Yes, if the picture is under copyright protection. I reiterate that generally, simply acknowloedging the source is not a defence to copyright infringement.

chenc SG

be careful when you cite. Other than the fact that you must observe the format expected by the owner, citation do not always save your ass.

Only a small amount of online sources, mostly written, are available for usage with proper citation.

Most copyrighted materials requires you to get a written permission from the owner before you can use it. Citation in this case will not get you out of jail.

ndmmxiaomayi SG

If that story has been written before (like Little Mermaid), you write your own character, develop it, and the animation has great sales, you are breaking the law.

Look in the first page of that book. It usually will state that the story has been copyrighted or All rights reserved or something similar.

If it doesn't state, then I just presume that the work has no copyright. One just have to credit that person(s) and contact the person(s) and tell them that you have used their idea to create an animation.

As for real person's life, you need to ask, unless it's your own life.

ndmmxiaomayi SG

For citation it really depends a lot. If you do it on a paper, citation must be in quotes, and putting the reference at the end of the report or whatever you are writing.

If it is on a website, you do it like paper, quoting the source at the bottom of your webpage, or if the owner states explicitly how they expect it to be cited, it can only be just a link.

Most owners usually can't be bothered about how the citation is done, unless it's some piece of major work. Suing for every minor rule that a user broke, is really too much. And waste of money also...

de_middle SG

no it doesn’t “offend”.......it violates

chenc SG

Lol legal citation acknowledge by court is a lot more complicated than what you described.
