Tuesday afternoon
i fetched a man from MBFC to Mohd Sultan Road.
along the way i spotted a lady riding an electric bicycle and
told him "look at that lady"
he saw the lady and said "she thinks people owe her a duty of
care not to knock her down"
i said "ah .. Donahue versus Stevenson"
he showed huge surprise and said "Good for you"
then i said "i think is was a Lord Dennings case. he wants the
lady to win the case instead of the huge corporation. Maybe we
should have more Lord Dennings in this world so that huge
corporation can't bully us"
again he said "good for you" and he turned his attention to his
mobile phone or tablet
maybe he was searching the internet for this case to see if i
was right.
Yes, you do owe her a duty of care not to knock her down.
The law protects the more vulnerable victim. You are
driving a more powerful and dangerous vehicle. As such you are
expected to keep a proper lookout.
