Odex owned you; time to own Odex back
Hi guys,
While most anime downloaders, especially PacNet users, are
rejoicing at the news, there may be news that might make you even
happier.
The latest Pacnet hearing has certainly flipped the tables on Odex;
both in it's result and the judicial reasoning employed to attain
that result. According to the Straits Times report, District Judge
Ernest Lau arrived at his judgment by two reasonings;
The draconian and drastic consequences of such an order upon the
receiving party; ie, thus, an extremely strong standard of proof
would be required for such an order in a civil case.
A proper action for copyright infringement should be brought
directly by the Japanese anime studios or the EXCLUSIVE LICENSEE.
Odex is a sub-licensee (don't ask me about the difference in
definition but hey, it's straight from the horse's mouth...) (Pay
attention to this one ) but Odex is NEITHER the copyright owner nor
EXCLUSIVE LICENSEE of the anime titles.
Interesting. So the point of my post?
According to a little used s.200 of our Copyright Act, , any person
threatened with legal action for copyright infringement may bring
an action to declare such threats unjustifiable, obtain an
injunction against further such threats and...
Recover damages he has sustained.
Yup, you heard right.
You can sue Odex for any damages they may have caused you as a
result of the now baseless legal threat they have made against you.
Especially if District Judge Ernest Lau's judicial reasoning is
upheld through appeal and thereby strengthened.
Furthermore, you may choose to launch this as a class action suit.
Anyone who was issued with the dread Odex letter can choose to join
the class action suit both concentrating your forces and of course,
spreading out the legal fees.
Dozo.
P.S There is considerable legal doubt whether the settlement
contract signed with Odex will stand. You can claim duress which
will render the contract void (I believe there are plenty of
substantial reasons which I won't go into here, to argue duress)
and any contract clauses that require you to give up your legal
cause of action against Odex smacks of illegality.
The Unfair Contract Terms Act was pretty unhelpful here but I
believe there are common law doctrines to be argued against those
clauses.
