Security guards, being employed by the school, can and have the
right to enforce school rules. For example, if you stayed in an
empty classroom beyond your welcome, you may be asked to leave. It
is the school's right to designate whether or not empty classrooms
are to be used by students and staff alike. Mind you, this is not a
student right issue here. Staff alike, if not given the green
light, may be asked to leave as well.
As for smoking and other behaviours within the school compound,
well, its the school rule, you can only obey. Its the same
anywhere.
As for smoking outside the school compound, the school certainly
have a right to set school rules. However, whether this is
technically enforceable or not... ask yourself:
Outside the school compound, security guards has got no
jurisdiction. They have as much rights as a common citizen.
1. Can a common citizen ask for your identification?
No, only public servants such as a police officer, or NEA officer
etc has the rights.
2. Can a common citizen stop you, and then restrain your movement
if you do not comply to their demands? (e.g. to ask for student
pass)
No. That constitutes unlawful restraint.
3. Can a common citizen chase after you to comply to his/her
demands?
No. That's harrassment.
4. What can i do if a security guard stops me outside my campus for
smoking?
You can simply walk away. They is no need to comply to his/her
demands.
You want to know your rights? There you got it.
Bewarned though, underage possession of tobacco products is an
offence. You will not want to be caught by the police for
that.
If you are =>18, you should be fine. If stopped, simply walk
away from the scene.
